No reprieve for convicted Briton

An appeals court reduced a British drug smuggler's prison term to 11 years from 14 years Oct. 27, saying he did no direct harm to society because the narcotics he was carrying were confiscated before they could be sold.

Nick Baker, a 34-year-old landscaper, was convicted by the Tokyo District Court in June 2003 and sentenced to 14 years in prison for smuggling more than 40,000 ecstasy tablets into Japan in a suitcase with a false bottom.

Tokyo High Court Judge Kenjiro Tao reduced Baker's prison term to 11 years and fined him ¥3 million because Baker was just "a bottom man" of a large smuggling ring, defense lawyer Shunji Miyake said.

Baker was arrested in 2002 in what was believed to be the largest single drug bust at Narita International Airport. He has denied the charge, saying he was tricked into carrying the suitcase through customs by another Briton with whom he was traveling.
